Sweepstakes Period.

The Sweepstakes period starts at 9:00AM EST on April 5, 2022 and ends at 11:59PM EST on April 20, 2022 ("Sweepstakes Period").

Eligibility

To be eligible to enter the Sweepstakes, you must be an individual who is a legal resident of the United States of America and be at least eighteen (18) years of age at the time of entry.

VOID IN ANY JURISDICTION WHERE PARTICIPATION IS PROHIBITED. All federal, state, and local laws and regulations apply.

By entering the Sweepstakes, you represent and warrant to Sponsor that you meet these criteria. You further represent and warrant that your participation in or attemped participation in the Sweepstakes does not violate any federal, state, or local law or regulation that governs your entry into the Sweepstakes.

Employees of SIGNA Sports United and its parents, subsidiaries, and affiliated companies and of Tennis-Point, LLC deba Tennis-Point and each of their immediate family members (spouses, parents and their spouses, children and their spouses, and siblings and their spouses), agents, and representatives are not eligible to enter in or win the Sweepstakes.

No other method of entry will be accepted. Only one (1) entry per eligible individual is permitted no matter how the Entry is submitted. Individuals entering or attempting to enter more than once will be disqualified. Mass entries generated by a script, macro, or use of automated devices will be disqualified.

Sponsor is not responsible for incorrect, inaccurate, or incomplete entry of information by entrants; lost Entries or transmissions; interrupted or unabailable network, server, or other connections; scrambled transmissions of other errors or problems of any kind whether mechanical, human or electric, technical malfunctions or the mobile hardware, software, or any combination therreof; problems associated with any virus or other damages caused to entrants' system. All Entries will become the sole property of Sponsor and cannot be returned.

The Prize:

The Sweepstakes will have one (1) winner (the "Winner") who will receive one (1) 2022 Babolat Pure Strike VS racquet (the "Prize"). The retail value of the Prize is $279.00

THE PRIZE IS NOT TRANSFERRABLE, AND ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE PRIZE, AND ANY COSTS AND EXPENSES ASSOCIATED WITH THE PRIZE, ARE THE SOLE RESPONSIBILITY OF THE INDIVIDUAL WHO WINS THE PRIZE.

No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent of the Prize by the Winner is permitted.

Drawing and Notification:

On or about April 21, 2022 at 12PM EST one (1) Entry will be selected randomly in a drawing from all eligible entries submitted. The odds of winning the Prize depend on the number of eligible Entries received.

The Winner will be notified by April 21, 2022 via the email address or telephone number provided in his or her Entry ("Winner Notification") that he or she has won the Prize. Sponsor is not responsible for and shall not be responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the Winner Notification. The award of the Prize to the Winner will be conditional on the Winner indicating to Sponsor within three (3) days of and in accordance with the instructions set forth in the Winner Notification that he or she is willing to accept the Prize. The award of the Prize to the Winner will also be conditional on the Winner submitting a Winner's Declaration (defined below) to Sponsor in accordance with the instructions set forth in the Winner Notification.

If the Winner does not indicate that he or she is willing to accept the Prize within three (3) days of Winner Notification, refuses to submit a Winner's Declaration (defined below), or is otherwise ineligible, the Prize may be forfeited and awarded to an alternate entrant who will be selected from the remaining eligible Entries at the sole discretion of Sponsor.

The Prize will be sent via USPS or FedEx to the confirmed Winner within ten (10) days of Winner Notification, provided that all requirements set forth in these Official Rules have been met.

Sponsor is not responsible for its inability to contact a Winner or deliver the Prize due to change of the Winner's email address or telephone number. If an entrant's email address or telephone number changes between the time he or she enters the Sweepstakes and the and the drawing date, it is the sole responsibility of the entrant to notify Sponsor of such change.

In the event of a dispure over the identity of a Winner who entered online, the Winner will be deemed to the Authorized Account Holder of the email address supplied with the Entry. "Authorized Account Holder" is defined as the natural person who is assigned an email address by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Winner's List

The name of the Winner will be posted to @tennis_point_usa on Instagram within thirty (30) business days after the end of the Sweepstakes Period. Alternatively, to review or request a Winner's List, send a letter to Tennis-Point ATTN: Pure Strike Sweepstakes 11613 Reading Road, Cincinnati, Ohio 45241 asking for same and include a self-addressed, postage pre-paid envelope with the letter or send an email to service@tennis-point.com with Pure Strike Sweepstakes as the subject line. The information will then be provided within a reasonable time after the Sweepstakes Period ends.

Winner's Declaration

Unless prohibited by law, the Winner will be required to sign and complete a Declaration of Eligibility/Liability and publicity grant (“Winner’s Declaration”), which will include consent to the use of the Winner's name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation worldwide in perpetuity and in any form of media including the Internet. The Winner’s Declaration must be returned to Sponsor within five (5) days of Winner Notification.

Release and Indemnity:

By participating or attempting to participate in the Sweepstakes, even if ineligible, you release, indemnify, and hold harmless Sponsor, its parent companies, affiliates, subsidiaries, legal advisors, and all related individuals and entities, as well as Facebook, Twitter, Instagram and their directors, officers, employees, agents, and independent contractors, (collectively, the “Released Entities”) from any and all liability, costs (including attorneys’ fees), losses, damages (including punitive, incidental, consequential, and special damages and lost profits), claims (including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy), or actions of any kind arising out of or relating to the Sweepstakes in any way, including, but not limited to, (1) entrants’ participation in the Sweepstakes; (2) any errors in evaluating the eligibility of entrants; (3) any acceptance, possession, ownership, misuse or use of the Prize or items purchased with the Prize; (4) any typographical, mechanical, technical, programming, human, or other error or malfunction in the printing, offering, selection, operation, or announcement of the Sweepstakes and/or the Prize; (5) any technical malfunctions of the computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor; and (6) any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects, and/or any other errors or malfunctions, even if caused by the negligence of the Released Entities.

Dispute Resolution:

By participating in the Sweepstakes, entrants agree to be bound by these complete Official Rules and by the decisions of Sponsor which shall be final and binding in all respects. Any disputes relating to the Sweepstakes arising between entrants or attempted entrants and Sponsor shall be submitted to the federal, state, and local courts located in Cincinnati, Ohio and resolved under the laws of the State of Ohio.

Miscellaneous:

Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules, including by, and without limitation, in its sole discretion, disqualifying any person tampering with the entry process, the operation of Sponsor’s website, or who is otherwise in violation of these Official Rules.

The invalidity or unenforceability of any provision of the Official Rules or Winner’s Declaration will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or Winner’s Declaration is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules.

Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

Sponsor reserves the right to cancel, terminate, or modify the Sweepstakes without notice. In the event of cancellation, the Prize may be awarded by random drawing of the eligible entries received prior to the date of the cancellation or not awarded at all, at Sponsor’s sole discretion.
