2022 ATP x Tennis-Point Promotion Terms and Conditions
These terms and conditions set out the basis on which you can participate in the 2022 ATP x Tennis-Point Promotion (the “Promotion”). By entering the Promotion, you accept these terms and conditions in full. If you do not accept these terms and conditions, you should not enter the Promotion and you will not be eligible to win the prize.
1.0 To win any prize or give-away, you must be 21 years of age or older at the time of entry, meet all of the eligibility requirements, and agree to these terms and conditions and the Privacy Statement (collectively, the “Rules”) that applies to any Promotion or giveaway. 1.1 The Promotion is valid from August 8th, 2022 at 11:00 A.M. Eastern Time through August 11th, 2022 at 11:59 P.M. Eastern Time (“Closing Date”). Entries received after the Closing Date will not be entered into the Promotion.
1.2 Eligibility to win any prizes is subject to the Rules. Eligibility is open only to those currently residing in the United States (except the states of Florida and New York).
1.3 No purchase is necessary to participate. Promotion and giveaways are void where prohibited.
1.4 To qualify, entrants must (1) follow @atptour and @TennisPointCom on Facebook, and (2) like the Promotion post on Facebook, by no later than the Closing Date. Per the Rules, there will be one overall Grand Prize Winner. The winner will be chosen at random from the qualified entrants. Only one entry per person will be counted. ATP Tour, Inc. (“ATP”) reserves the right to change, modify, or end the Promotion if it appears someone is attempting to send multiple and/or automated entries or otherwise interfere with the Promotion. The submission of more than one entry automatically disqualifies the person submitting multiple entries from the Promotion.
1.5 The winner, in accordance with section 1.4 above, will receive:
Grand Prize Winner
Prize 1: A $500 gift card voucher to be redeemed at Tennis-Point.com before 8/30/2023 or at the Tennis-Point retail tent on site at the Western & Southern Open in Cincinnati August 13 - August 21, 2022. Approximate Value: $500.
Prize 2: 2 x tickets for the Western & Southern Open in Cincinnati for Sunday, August 21st, 2022. Approximate Value: $558.

1.6 Employees of ATP, Tennis-Point and ATP tournaments (including any of their respective affiliates or subsidiaries), their family members, and those living in the same household as any such employees are not eligible to win any prize. In addition, all ATP players, their family members and coaches and agents are not eligible to submit an entry.
1.7 Entries become property of ATP and will not be returned. The submission of any entry into the Promotion shall constitute the express agreement of the person submitting such entry to the Rules of the Promotion and any determinations made by ATP or other company connected to the Promotion. In addition, any eligible entrant who may be eligible to win a prize must comply with the affidavit as described below, non-compliance with the terms and conditions of such paragraph will constitute a forfeiture of any prize without compensation and without recourse.
1.8 A representative of ATP will contact the winner by e-mail within 7 business days of the conclusion of the Promotion. Before sending any prize, ATP will send the winner an affidavit and release of liability and publicity, which the winner must sign and return within 3 days of receipt. If the winner fails to return the signed affidavit within 3 days of receipt, ATP will disqualify him or her and select an alternate winner, if applicable.
1.9 ATP shall have no liability in connection with the awarding or use of any prizes other than upon receipt within the specified time frame of the winners' affidavits of eligibility and release, to send the prizes to the winners at the address listed in the winner's registration.
1.10 The winner must execute an affidavit of eligibility and release, including (i) confirming compliance with the Rules, (ii) agreement to accept the prize awarded, (iii) release, discharge and hold harmless ATP, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising, members and promotional agencies, counsel, marketing partners, Facebook and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Promotion ("Released Parties") from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the entry by the ATP, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Promotion to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Promotion or any prize, liability for physical injury, death, or property damage that the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Promotion and/or in connection with the acceptance and/or exercise by the entrant of the prize as awarded; (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Promotion Rules or participation in the Promotion and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the entry by ATP, and (v) the grant to ATP and Tennis-Point, and their designees, of the right to use the winner's name and likeness in advertising and otherwise, except where prohibited by law.
1.11 The winner is responsible for any costs, expenses and taxes that may be due as a result of winning a prize.
1.12 Should there be a dispute over the identity of a qualified entrant, it shall be resolved in favor of the holder of the e-mail account used to enter the Promotion. If the winner provides incorrect information that precludes delivery of the prizes, such winner forfeits any prize that he or she may have been eligible to win.
1.13 Any decisions of ATP regarding winners shall be final and binding.
1.14 ATP reserves the right to cancel or modify the Promotion for any reason ATP deems necessary, including substituting the prize (or any part of it/them) for a prize or prizes of equivalent or greater monetary value if this is necessary. ATP may change any terms and conditions applicable to the Promotion in its sole discretion at any time.
1.15 ATP shall not be responsible and shall have no liability for lost, misdirected, or late entries; or for (i) electronic transmission errors, (ii) theft, destruction, alteration, or unauthorized access of or to entries, (iii) technical problems, malfunctions, or errors in the operation of any hardware or software required to transmit entries or operate any Promotion or giveaways as planned (including computer viruses or bugs, tampering, unauthorized intervention, fraud, traffic congestion on the Internet or at any website, any combination of the foregoing, or any other causes beyond the control of ATP. If any of the foregoing occurs, ATP reserves the right in its sole discretion to take any one or more of these steps: disqualify any individual who tampers with the entry or voting process; cancel, modify, delay, or suspend a Promotion or giveaway. CAUTION: any attempt by anyone to deliberately damage any website or undermine the legitimate operation of a Promotion or giveaway is a violation of criminal and civil laws for which ATP reserves the right to seek damages from such person to the fullest extent of the law.
1.16 Third party terms and conditions apply to parts of the prize where applicable.
